1. Techtile
will not, in any way be held responsible for any of the
following, or any other cause or contingency whatsoever beyond
the control of the Company, whether of a similar nature to the
following causes or not. Loss, or damage arising from strikes,
lockouts, cessation of
labour,
transport delays, shortened hours of
labour,
war, or accidents of any kind.
2. Any
drawings submitted with any quote remain the property of
Techtile and may not be reproduced in any form without written
authority from this Company.
3. Any delivery dates given by Techtile for goods is approximate
only, and Techtile cannot be held responsible for any loss
howsoever caused due to the failure to deliver on a specific
date at a specific time.
4. Claims for goods damaged in transit must be notified within
three working days of receipt of goods. Where outside
contractors are used to deliver goods, late deliveries must be
notified within five working days.
5. Techtile reserves the right to charge in full, any costs paid
or contracted for, in respect of an order being amended or
cancelled. Techtile also reserves the right to charge storage
costs in the event of an order being postponed.
6. Any damage occasioned to the goods after delivery to the
customers premises or site, will be the sole responsibility of
the customer.
7. The trading terms are Net Monthly Account unless otherwise
agreed in writing. All quotations are based on conditions as to
material, transport and
labour
which exist at the time they are given. All goods delivered will
be charged at prices ruling at the date of
despatch,
and the title of the goods shall not pass to the Customer unless
payment is made in full.
As well as any rights to which it may be entitled, Techtile
shall, in the event of a non-payment, be entitled to a general
lien on all goods of the Customer that may be in Techtiles
charge or possession - whether paid for or not. This lien shall
not exceed the unpaid price for any goods sold and delivered to
the Customer by Techtile under this or any contract.
8. Goods proven to be defective within 12 months from the date
of dispatch from Techtile works will be replaced at the place of
original delivery, but Techtile liability shall in no
circumstances exceed the invoice value of the goods accepted as
defective. In no circumstances will allowances be made for
Customers labour, consequential loss or damage, or any other
expenses.
